3. Strict Financial and Investment Non-Advice Disclaimer

• Drawdown and Rule Strictness: Trailing maximum drawdown rules, daily loss limits, consistency metrics, and news trading restrictions can lead to immediate account termination upon rule breach.

12. Intellectual Property Rights

The Platform, its entire codebase, user interface designs, logos, trademarks, proprietary algorithms (including the Navigator engine and simulation models), and curated database schemas are the exclusive intellectual property of N73 Funding and are protected by international copyright and intellectual property laws.

13. Prohibited Conduct

When accessing or using the Platform, you agree not to:

THE PLATFORM AND ALL CONTENT, CALCULATORS, SIMULATION TOOLS, REVIEWS, AND FIRM LISTINGS ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, N73 FUNDING EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT INFORMATION PROVIDED WILL BE COMPLETELY ACCURATE OR RETRIEVABLE AT ALL TIMES.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL N73 FUNDING, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF TRADING PROFITS, CAPITAL LOSSES, CHALLENGE EVALUATION FEES PAID TO THIRD PARTIES, DENIED PAYOUTS BY PROPRIETARY FIRMS, BUSINESS INTERRUPTION, LOSS OF DATA, OR LOSS OF GOODWILL, WHETHER ARISING UNDER CONTRACT, TORT, OR OTHERWISE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD) OR THE TOTAL AMOUNT PAID BY YOU DIRECTLY TO N73 FUNDING IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to defend, indemnify, and hold harmless N73 Funding, its parent company, subsidiaries, affiliates, officers, directors, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Platform and its tools.
• Your violation of these Terms of Use or any applicable law.
• Your submitted user reviews, dispute documentation, or reward claims.
• Your interactions, contracts, or disputes with any third-party proprietary trading firm listed on the Platform.

17. Governing Law, Dispute Resolution, and Notices

These Terms and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the laws of international commercial arbitration and standard corporate law principles, without giving effect to conflict of laws rules.

Informal Resolution: Before initiating formal legal proceedings, you agree to contact us at legal@n73funding.com and make a good-faith effort to resolve any dispute informally.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.
